Autopsy ratifies death by strangulation of man suffocated by a policeman in Torrejón
Thoracic understanding and/or cervical dam with homicidal etiology. That is the only possible cause of the death that collects the Akkouhim autopsy, the 35 -year -old who died asphyxiated in Torrejón de Ardoz at the hands of a municipal police in Madrid, to which Eldiario.es has had access. Aided by another retired agent of the same body, the Madrid policeman practiced the Mataleón technique until Abderrahim died drowned in the face of the warnings of what was happening by several witnesses of the scene.
Family lawyers demand that this agent, the only one investigated in the case and respond to the acronym of JJTC, enters preventive detention and that the Prosecutor's Office supports that the other policeman, Papc, will be present in the case as investigated instead of a witness. “The autopsy comes to confirm what we always defended, what appears in the videos and what the acts of the toilets collected,” explains Rubén Vaquero, a family lawyer the Akkouh. According to the document signed by the National Institute of Toxicology and Forensic Sciences sent to the parties this August, and to which this newspaper has had exclusive access, the only possible cause of the death it collects is asphyxiation by thoracic understanding. That is, Abderrahim could not breathe because his chest was compressed, which prevented the expansion of his lungs.
The autopsy, in which the heart, larynx and lungs of Abderrahim have been analyzed, adds that the death of this man of Maghreb origin could also be owed to a cervical dam. It refers to a strangulation or neck maneuver that blocks air inlet or blood circulation into the brain.
Finally, the autopsy collects that the body presented “homicidal etiology.” According to Vaquero, this “means that the cause of death was not accidental or natural, but is considered intentionally caused by another person; that is, it is a homicide, a murder.” On the other hand, the medical report that the Summa 112 optional made of the intervention in June, in which ABDERRAHIM tried to save by cardiopulmonary resuscitation for more than half an hour, states that after carrying out the part of death, the collegiate warned the Judicial Police for “violent death in public roads”.
They discard other possible causes of death
The Akkouh family will defend the Judge of Instruction of the Court number 4 of Torrejón de Ardoz, who has already practiced the first proceedings, which what happened was a murder and not a reckless homicide. “There are still some statements to agents who acted that night, and there we will ask again that PAPC is also investigated because we understand that he was an essential JJTC collaborator when Abderrahim grabbed the legs to the legs to immobilize him and prevent him from defending himself,” the lawyer explains.
The definitive autopsy of Abderrahim's body confirms the preliminary, performed by the forensic doctor who lifted the body. It already pointed to anoxia, lack of oxygen in the body, as a cause of death. “Now we can despise any type of heart condition or cerebral infarction. We know that death was caused by the whole world has been able to see in the videos and that the witnesses endorsed,” the same cowboy affects.
During the first half of July, several police officers and witnesses testified to the magistrate. This media agreed to the recordings of the statements, in which two people who were present during the police action assured that Abderrahim did not oppose resistance and that he had a purple head because of the strangulation he was suffering. In that same view, the retired policeman said that the Mataleón technique “is done only very sporadically”, while one of the national police officers who first arrived at the scene added that it is a technique “dangerous, if it is not known to apply.”
To what extent society condemns these crimes
The endorsement provided by the definitive autopsy to the thesis that the family always wielded Akkouh will be used by lawyers to try that the criminal type of investigation passes by homicide reckless to intelligible homicide. Vaquero explains that if so the lower penalty would reach ten years in prison and could rise until 15. In addition, they could get the procedure to be settled with a popular jury: “We understand that we have more guarantees that justice be done, with ten civilians and a magistrate, where the judge has all the decision -making power.”
Vaquero understands this way of judging the only investigated at the moment as “an opportunity not only to explain what happened from the strictly legal point of view, but will allow us to see to what extent society supports this type of crime.” From his perspective, what happened with Abderrahim is a good time for a turning point to be marked and “the racist face that has always had to endure the family”, in his own words.
The Akkouh family, meanwhile, demands results and advances. “They want them to put in pretrial detention to which the Mataleón did and that the other policeman who held Abderrahim on the legs is also investigated,” reiterates his lawyer in reference to PAPC this was the agent who snapped “you deserve that you die right now, bastard”, to the already inert body of Abderrahim after the arrival of more police officers to the area, according to a video published by Eldiario.
Delay in autopsy
The same cowboy has branded as “lack of consideration” the time it has taken to arrive the final autopsy, whose opinion was resolved on August 7. “This delay should have been remedied with all the economic potential of the administration of justice,” he says. On the other hand, he criticizes that the delay has caused an “exacerbated pain” in the relatives of Abderrahim due to the “constant revictimization they have lived since their murder.”
The lawyer recalls that “justice, if it does not arrive on time, is not justice.” And it ends: “We want to counteract by all means the inhuman treatment that the family is receiving, although it is not an easy issue because the perpetrator is a municipal police.”
