
US imposes a “anti -dumping” tariff of 28.55% for the wind towers of Siemens Gamesa and Windar
The United States International Trade Court (CIT) has determined of its subsidiaries.
The decision, adopted on January 28 and will be published on Tuesday in the Federal Registry, the BOE of the North American country, is a reduction with respect to the 73% set of 73% established preliminary in 2021 and against which Siemens claimed Gamesa
In this sense, Siemens Gamesa challenged the preliminary decision claiming that the allocation by the trade department of the 73% rate “was illegal.” Although in a first determination trade he maintained his preliminary decision to establish a margin of estimated average weighted dumping of 73%, in a second determination he concluded that the margin of average dumping weighted to set was 28.55%.
In this way, in the final judgment issued by Judge Timothy C. Stanceu, the Court confirms the decision of the Department of Commerce in that second redetermination that assigns a margin of dumping of 28.55% to the entity composed by Siemens Gamesa, Windar and Windar manufacturing subsidiaries.
In the judge's opinion, this second redetermination “remedied the deficiencies that the court identified in Siemens Gamesa I and Siemens Gamesa II” while rejecting claims that Siemens Gamesa should not have been investigated, which fused illegally with Windar and the Windar manufacturing subsidiaries and that the Department of Commerce illegally determined the reconstructed export price of the merchandise in question.
